These Terms of Service apply to nanobanana-pro.com and related services made available under the Nanobanana Pro name. Nanobanana Pro is operated by Mok Kam Kuen in Hong Kong.

By accessing or using the service, you agree to be bound by these Terms of Service, our Privacy Policy, our Cookie Policy, and any additional rules or policies that apply to specific features.

1. The service

Nanobanana Pro provides AI image generation and editing tools, including text-to-image generation, reference-image editing, accounts, billing, subscriptions, credits, history, downloads, and related features.

We may add, modify, suspend, or discontinue any part of the service at any time.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement in your jurisdiction in order to use the service.

You agree to:

• Provide accurate and current account information
• Keep your login credentials secure
• Be responsible for activity that occurs under your account
• Notify us promptly of any unauthorized access or security incident

We may require identity or ownership verification in connection with support, billing, fraud prevention, or account recovery.

3. Acceptable use

You may use the service only in compliance with applicable law and these Terms.

You must not:

• Violate any law, regulation, court order, or third-party right
• Upload or generate unlawful, infringing, abusive, hateful, exploitative, fraudulent, or harmful content
• Misuse the service to distribute malware, spam, or malicious code
• Attempt unauthorized access to systems, accounts, or networks
• Circumvent usage limits, moderation systems, payment systems, or security controls
• Scrape, mirror, resell, or exploit the service in an unauthorized way
• Use the service to train competing models or build competing datasets without permission

We may investigate suspected violations and take action including removing content, restricting access, suspending features, canceling credits, or terminating accounts.

4. User inputs

You retain rights you lawfully own in prompts, uploaded images, text, and other material you submit to the service.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, and use that material as reasonably necessary to:

• Operate and deliver the service
• Generate and return outputs
• Maintain safety, moderation, fraud prevention, and support functions
• Debug, improve, and secure the platform
• Comply with law and resolve disputes

You represent that you have all rights needed to submit your inputs and authorize us to process them.

5. AI outputs

Subject to your compliance with these Terms and applicable law, you may use outputs generated for you through the service.

However:

• AI outputs may not be unique
• Similar or identical outputs may be generated for other users
• We do not guarantee that outputs are non-infringing, accurate, or fit for a particular purpose
• You are responsible for reviewing outputs before publishing, commercializing, or relying on them

We do not claim ownership over outputs generated for you. To the maximum extent permitted by law, we assign to you any rights we may otherwise have in those outputs, subject to these Terms, the rights of third parties, and the limited rights we retain to operate, secure, comply with law, and improve the service.

6. Billing, subscriptions, and credits

Some features require payment.

When you purchase a subscription or credits:

• You authorize us and our payment processor to charge the applicable fees
• Subscription plans may renew automatically until canceled
• Credits are a limited service entitlement, not stored value, currency, or property
• Credits may expire, be adjusted, or be canceled according to the relevant plan or promotional rules
• Different models, resolutions, or features may consume different amounts of credits

We may change pricing, plan structure, credit amounts, or feature availability for future purchases or renewal periods.

7. Cancellations and refunds

You may cancel subscriptions through the billing area or customer portal when available.

Unless required by applicable law or expressly stated otherwise:

• Fees paid are generally non-refundable
• Used, granted, expired, or promotional credits are generally non-refundable and non-convertible to cash
• We may, at our discretion, restore or adjust credits in cases such as failed jobs, duplicate charges, abuse investigations, or technical errors

Where mandatory consumer law gives you additional rights, those rights will apply.

8. Third-party services

The service depends on third-party providers such as cloud infrastructure, payment processors, email providers, analytics tools, security tools, customer support tools, and AI-related vendors.

We are not responsible for outages, errors, policy changes, or acts of third parties, although we will make reasonable efforts to maintain service continuity.

9. Termination and suspension

We may suspend or terminate access to the service if:

• You violate these Terms or applicable law
• Your conduct creates security, fraud, abuse, payment, or legal risk
• We are required to do so by law, regulation, or court order
• We need to protect users, systems, providers, or business operations

You may stop using the service at any time. Certain provisions will continue after termination, including those relating to payments, intellectual property, disclaimers, liability limits, and dispute resolution.

10. Disclaimers

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that:

• The service will be uninterrupted, secure, or error-free
• Outputs will be accurate, lawful, unique, or suitable for any specific use
• Any specific model, feature, price, or integration will remain available

11. Limitation of liability

To the maximum extent permitted by law, we and our affiliates, officers, employees, contractors, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service will not exceed the greater of:

• The amount you paid us for the relevant service during the 12 months before the claim arose, or
• SGD 100

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict of laws principles.

Any dispute arising out of or in connection with the service or these Terms will be subject to the exclusive jurisdiction of the courts of Singapore, unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
